Dental malpractice occurs when a dentist fails to provide to you with the reasonable care required of dentists for the type of condition being treated. Dental malpractice cases can be costly. The harm caused must outweigh the financial and emotional costs that must be invested to pursue a claim. Sometimes the best of care does not produce a desired result. It is not the result of medical care that the law considers, but the law focuses on the quality of that care, and the consequence of substandard care. International Journal of Phytoremediation (1) Once medical malpractice has been proven, it is necessary to show that the damage has been caused as a result of negligence, which is difficult because the patient was already ill when the negligent treatment started. Typically, the medical malpractice attorney will show the natural progression of the underlying condition and what the outcome would have been if the patient received proper treatment to establish what a difference the negligence made. However, the definition for medical malpractice differs from state to state, and so does the statute of limitation. Under the traditional collateral source rule, payments received by the malpractice victim from third parties such as medical insurance companies would not be considered in the calculation of damages. Colorado has modified this rule, such that a claimaint's damages are reduced by the amount of payments received from collateral sources for which the plaintiff did not contract and make payment. However, where the plaintiff did contract for and pay for the benefits, the collateral source payments do not reduce the judgment. 2. Stuff happens. A bad outcome does not necessarily mean a medical error was committed. To prove a case for medical negligence, an injured person must show that a medical provider breached the standard of care, that is, acted imprudently or unreasonably. For example, most hospital acquired infections are not proper malpractice claims because, despite rigorous infection control procedures, infections can and do still occur. However, the failure to promptly identify and treat that same infection may be grounds for a viable medical malpractice claim. Massachusetts medical malpractice law is largely governed by a statute, Massachusetts General Laws Chapter 231 Sections 60B-I. Among other things, the statute sets up a tribunal system for medical malpractice cases. This means that at the outset of the case, the victim, through his attorney, must present a detailed expert opinion that the care received was substandard and caused the victim's injury. The opinion, submitted in what is known as an offer of proof, is reviewed by a court-convened tribunal consisting of a judge, a lawyer, and a physician. If the plaintiff fails to make adequate proof, the victim must post a six thousand dollar bond to go forward with the case, or the case will be dismissed. For this reason, among others, detailed preparation and thorough review by qualified malpractice attorneys with access to quality medical experts early on is essential. Because of the way damages can be awarded in South Dakota, the economic calculus means that many deserving clients will not get their shot at justice, lawyers say. Steve Johnson, one of the state's top plaintiff lawyers, decided recently to stop taking medical malpractice cases, in part because of the cap on noneconomic damages.

Objectives: The research explored the current practices of information literacy (IL) instruction in medical libraries of Pakistan. Methods: A semi-structured questionnaire was mailed to the head librarians of all 114 academic medical libraries in Pakistan. It investigated the types of IL instruction provided, topics covered, methods of delivery and assessment, level of integration in the curriculum, and level of collaboration with teaching staff. Results: The study revealed that 74% of the respondents had offered some types of IL instruction in their institutions during the previous year, ranging from library orientation to research-level skills. IL instruction is typically only offered to new students or first-time library users or on demand. A majority of the respondents developed IL instruction programs without faculty involvement. Librarians were primarily responsible for offering IL instruction in medical institutions. Face-to-face instruction in computer labs or lecture halls and individual instruction at reference desks were identified as the most common IL instruction delivery methods. The data indicated that oral feedback, written feedback, and searching in a computer lab were the most popular assessment methods that medical librarians used. Conclusion: IL instruction activities in medical libraries of Pakistan are in their infancy. Medical librarians also lack systematic approaches to IL instruction. Implications: Medical librarians need to develop educational partnerships with faculty for integrating IL instruction into the mainstream curriculum. For instance, although the report alleges that Zavala's extraction procedure required mandibular support and that Pinkerton and Bandy did not provide it, it omits any explanation about how the failure to provide mandibular support caused Zavala's injuries or how providing that support would have prevented them. It simply concludes that the failure to do so was a contributing cause of her injuries. Because Jones's report lacked information as to causation, it did not provide a basis for the trial court to conclude that Zavala's claims had merit. Jernigan, 195 S.W.3d at 93; Palacios, 46 S.W.3d at 875. Based on this omission, the trial court could have reasonably determined that the third report did not represent a good-faith effort to summarize the causal relationship between Pinkerton and Bandy's alleged departures from the standard of care and Zavala's claimed injuries.
